THIRD — Delivery & habitability certificate (CRUCIAL)
Construction to be completed: Q2 2025. Maximum 101 days extension for force majeure.
If at escritura the Licencia de Primera Ocupación had not been granted, the Director Architect was to issue a duly authenticated certificate confirming that the works met habitability standards.
Actual performance: escritura 26 August 2024. To 23 May 2026 — 21 months later — no LPO, no habitability certificate, no Certificado Final de Obras authenticated and delivered.
FIFTH — Acta de recepción
At handover an acta de recepción was to be drawn up recording all deficiencies.
Actual performance: defects reported immediately after October 2024 delivery — no acta de recepción drawn up by MASA.
SEVENTH — Breach
In case of breach by MASA (particularly delivery date and escritura), the buyer may opt for performance OR rescission, with MASA refunding all amounts paid to date.
Current position
21 months after escritura, with €203,500 paid + approximately €25,000 in additional costs, the buyer has received:
- No Licencia de Primera Ocupación
- No Certificado Final de Obras authenticated/delivered
- No architect habitability certificate
- No tourist licence (dependent on LPO)
- Since 21/04/2026: no electricity supply
